Symbian Redistribution and Use Licence

This Symbian Redistribution and Use Licence ("Licence") is a licence between you (either as an individual or as an organisation such as a company) and Symbian Software Limited.  This Licence sets out the terms on which you may use the Symbian software you have downloaded or otherwise obtained ("Software"). 
The Software is protected by international copyright and other intellectual property laws and treaty promises, and copyright and other intellectual property rights in and to the software is owned by Symbian and Symbian's Licensors.  All rights not specifically granted under this Licence are reserved by Symbian, and any actions you take in relation to the Software which are not in accordance with the terms of this Licence may infringe copyright or other intellectual property rights.  By using or redistributing the Software, you indicate your acceptance of the terms of this Licence. 

GRANT OF LICENSE

Symbian grants to you the non-exclusive, limited right to use the Software for the purpose of developing and testing an Application and to use the Software as part of or in conjunction with an Application, where an "Application" is a software product that either operates on devices that make use of Symbian OS as their primary operating system, or is a software development tool for Symbian OS, or must utilize, or convert to or from Symbian OS file formats.

REDISTRIBUTION

You may redistribute and make available whole copies of the Software, provided each recipient of the Software receives a copy of this Licence and their use of the Software is made subject to the terms of this Licence. You may only redistribute the Software as a whole, and may not separately distribute individual components from within the Software.

For the avoidance of doubt, this Licence does not grant you any rights to sub-licence your rights of the Software under this Licence. Each recipient of the Software receives a licence directly from Symbian. 

COPYRIGHT NOTICES

Each copy of the Software you create must include a copyright notice as follows:

"This product includes Software licensed from Symbian Software Limited and its licensors (c) Symbian Software Limited and its licensors 1998-2007". 

Each copy of the Software you create shall also reproduce any other proprietary notices contained within the Software. 

Where you distribute the Software for use as part of, or in conjunction with your Application, you shall include the above copyright and proprietary notices with equal prominence to any other copyright notices in your Application (including its documentation). 

TRADE MARKS

This Licence does not grant you any rights to use Symbian's or its licensors' trade marks, names or logos on or in relation to your Application.  Neither the name of Symbian nor the name of any of its licensors may be used to endorse or promote products derived from the Software without specific prior written permission. 

DISCLAIMER OF WARRANTY

THIS SOFTWARE IS PROVIDED BY SYMBIAN AND ITS LICENSORS "AS IS"AND ANY EXPRESS OR IMPLIED WARRANTIES, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE ARE DISCLAIMED.  IN NO EVENT SHALL SYMBIAN AND ITS LICENSORS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES (INCLUDING, BUT NOT LIMITED TO, PROCUREMENT OF SUBSTITUTE GOODS OR SERVICES; LOSS OF USE, DATE, OR PROFITS; OR BUSINESS INTERRUPTION) HOWEVER CAUSED AND ON ANY THEORY OF LIABILITY, WHETHER IN CONTRACT, STRICT LIABILITY, OR TORT (INCLUDING NEGLIGENCE OR OTHERWISE) ARISING IN ANY WAY OUT OF THE USE OF THIS SOFTWARE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGE.

LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SYMBIAN BE LIABLE FOR ANY SPECIAL, DIRECT, INDIRECT, INCIDENTAL, ECONOMIC, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES, HOWEVER CAUSED AND WHETHER ARISING UNDER CONTRACT, TORT, NEGLIGENCE, OR OTHER THEORY OF LIABILITY ARISING OUT OF THE USE OF OR INABILITY TO USE THE SOFTWARE, EVEN IF SYMBIAN IS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. WHERE APPLICABLE LAW DOES NOT ALLOW THE EXCLUSION OF LIABILITY, SYMBIANS' LIABILITY SHALL BE LIMITED TO €100.

Nothing contained in this Licence shall prejudice the statutory rights of any party dealing as a consumer.  Nothing contained in this Licence limits Symbian's liability to you in the event of death or personal injury resulting from Symbian's negligence.

TERMINATION

You may not copy, make available, or distribute the Software except as expressly set out in this Licence.  If you fail to comply with the terms of this Licence, then Symbian may terminate this Licence.

GOVERNING LAW

This Licence shall be construed in accordance with the laws of England, and you and Symbian inevitably submit to the non-exclusive jurisdiction of the English Courts, save that Symbian may initiate proceedings against you in any competent jurisdiction.
